Bankruptcy Fees and Costs

Chapter 7:

Base Attorney’s Fee:  $1,250

Court Filing Fee:  $338.

Credit Counseling Course:  $20 (per household)

Credit Report: $36 (Ind) / $57 (Joint)

Financial Management Crs: $20 (per household)

Total Base Amount: $1,664 (Ind) / $1,685 (Joint)

* Base attorney’s fees may be higher if a business is involved or multiple affirmation agreements and judgements need to be included in your Chapter 7 filing.

Chapter 13:

Base Attorney’s Fee:  $4,000

Court Filing Fee:  $313.

Credit Counseling Course:  $20 (per household)

Credit Report: $36 (Ind) / $57 (Joint)

Financial Management Crs: $20 (per household)

* Base attorney’s fees are intended to allow the attorney to represent the client(s) for the duration of the Chapter 13 process (3 to 5 years). Attorney may charge additional fees and court costs when adversarial proceedings and additional court costs are necessary during the 3 to 5 year process.

Injury Fees and Costs

The base Attorney’s fee is based on a contingency percentage depending on the type of case (personal injury, medical malpractice, or wrongful death).

Contingency Fee:

Personal Injury:  30%

Medical Malpractice:  45%

Wrongful Death:  45%

Costs:  Costs are paid by the law firm and only paid by the client if a settlement is reached or a verdict in favor of our client is awarded in court.  These costs are collected out of the proceeds of the settement/award.

Costs May Include:

Court Filing Fees:  $215 and up (County Specific)

Process Server: $50 and up (County or Private Specific) (Additional Costs for Multiple Defendants)

Medical Records: (Healthcare Provider Specific)

Postage: (Costs are confirmed with client)

Private Investigator: $75 to $125 and higher depending on the services required by the private investigator and their hourly rates.

Legal Nurse Consultant

Expert Witness: $500 to $100,000 and up (This costs depends on the type of case, number of required experts, and length of time case takes to resolve [1 year to 6 years and more in some cases]. This is a requirement under O.C.G.A. Section 9-11-9.1)
